CHARLESTON, W.Va. — Attorney General JB McCuskey is urging West Virginians to check whether they qualify for compensation following preliminary court approval of a plan to distribute settlement funds tied to inflated generic drug prices.
The U.S. District Court for the District of Connecticut granted preliminary approval this month for a multistate distribution plan filed by West Virginia and 47 other states and territories. The plan will return a portion of approximately $96.5 million in settlements with six generic drug manufacturers accused of conspiring to raise prices: Glenmark, Lannett, Bausch, Apotex, Heritage, and Emcure.
Consumers who purchased certain generic drugs between May 2009 and December 2019 may be eligible for compensation. Eligibility information and claim forms are available at AGGenericDrugs.com, by calling 1‑866‑290‑0182, or by emailing info@AGGenericDrugs.com.
The settlements stem from a series of antitrust cases launched in 2016, alleging widespread price‑fixing among generic drug manufacturers. According to the complaints, executives used phrases like “fair share” and “playing nice in the sandbox” to coordinate pricing and discourage competition.
Nearly every U.S. state and territory joined West Virginia in the announcement, including Alaska, California, Florida, Kentucky, Ohio, Pennsylvania, Virginia, and Wyoming.
