Public Comments Scheduled on Proposed Rules to Implement HB 2014

CHARLESTON, W.Va. — The Public Service Commission of West Virginia will take public comments later this month on proposed rules tied to House Bill 2014, the Power Generation and Consumption Act, which outlines new electric‑capacity requirements for utilities statewide.

The hearing is set for 9:30 a.m. September 28 in the Howard M. Cunningham Hearing Room at 201 Brooks Street, Charleston.

Passed in April 2025, HB 2014 directs the Commission to evaluate capacity auctions conducted by PJM Interconnection — the regional grid serving 13 states — and to review each generating unit’s economic dispatch to ensure utilities can meet future demand. The law also requires utilities to maintain fuel inventories and generating units capable of achieving at least a 69 percent capacity factor.

The PSC opened a general investigation in July to gather recommendations and accepted written comments through August 10. Members of the public who wish to speak at the September hearing must notify the Commission by September 18, and may submit additional materials by September 23.

More information is available on the PSC website under Case No. 26‑0633‑E‑GI, and full text of HB 2014 can be found on the West Virginia Legislature’s website.
