Charleston, WV-West Virginia lawmakers have introduced House Bill 4878, a measure aimed at strengthening the state’s existing castle doctrine and expanding legal protections for residents who use force in self‑defense. The bill was introduced on January 28, 2026, and referred to the House Judiciary Committee for consideration.
HB 4878 proposes amendments to §55‑7‑22 of state code, clarifying when individuals may lawfully use force — including deadly force — to defend themselves, their homes, and their property. The legislation states that a lawful occupant may use force if they reasonably believe an intruder intends to cause death, serious bodily harm, or commit a felony.
The bill also provides broad civil and criminal immunity for individuals who act within the law, shielding them from prosecution and civil lawsuits when force is justified. Additionally, HB 4878 allows those who successfully assert the defense to recover court costs, fees, and related expenses.
Supporters say the measure strengthens self‑defense rights and removes ambiguity for homeowners confronted with threats. The bill is now awaiting further action in the House Judiciary Committee.
